Phil’s On It — Terms & Conditions

These Terms & Conditions apply to transport and Driver Only services provided by Phil’s On It.
By confirming a booking, the customer agrees to these Terms & Conditions.
1. Quotes and bookings
Prices generated by the Phil’s On It website instant quote tool are estimates only. Submitting an online quote or enquiry does not create a booking or contract.
Before accepting a job, Phil’s On It may confirm the items being transported, collection and delivery locations, access arrangements, timings, loading requirements and any other relevant details.
The final price will be confirmed directly with the customer.
A booking is only secured once Phil’s On It has accepted the job and the required payment or deposit has been received.
2. Payment
Unless otherwise agreed, payment in full is required to secure a booking.
For larger jobs, Phil’s On It may agree to accept a 20% deposit, with the remaining 80% payable no later than 24 hours before the scheduled job.
Where the balance is not received by the agreed deadline, Phil’s On It may treat the booking as cancelled by the customer.
Payment is normally made by bank transfer unless another method is specifically agreed.
3. Customer cancellations
Unless otherwise agreed:
More than 48 hours before the scheduled job:
The customer will receive a refund less any deposit paid. Where the booking was originally paid in full, Phil’s On It may retain 20% of the booking price.
Between 24 and 48 hours before the scheduled job:
50% of the booking price will normally be refunded. The amount retained will not be less than an agreed deposit or 20% of the booking price.
Less than 24 hours before the scheduled job:
No refund will normally be provided.
Cancellation charges reflect time reserved for the customer, administration and preparation already undertaken, costs incurred and the reduced opportunity to accept replacement work.
Nothing in these terms affects any statutory rights that cannot legally be excluded.
4. Cancellation or changes by Phil’s On It
Occasionally a job may need to be changed, delayed or cancelled because of circumstances outside reasonable control, including vehicle breakdown, illness, severe weather, unsafe conditions, road closures or other significant disruption.
Where reasonably possible, Phil’s On It may offer an alternative time, date, collection or delivery location, or another reasonable arrangement that allows the job to be completed.
Where a reasonable alternative is offered but declined by the customer, a full refund may not be due. Any refund will take account of the circumstances, work already undertaken, costs incurred and whether the alternative offered was reasonable.
Where Phil’s On It cancels a job and is unable to provide a reasonable alternative, payment for the service not provided will be refunded.
Nothing in this section affects the customer’s statutory rights.
5. Collection and delivery times
Collection and delivery times will be agreed as accurately as reasonably possible.
Traffic, road closures, weather, accidents and other circumstances outside reasonable control can affect journey times. Unless expressly agreed otherwise, collection and delivery times should therefore not be treated as an absolute guarantee.
Customers must tell Phil’s On It before booking where a collection or delivery is particularly time-critical.
6. Loading, unloading and waiting time
The agreed price includes the loading, unloading and waiting allowance stated in the quote or booking confirmation.
The customer is responsible for ensuring that items, access and any people required to assist are ready at the agreed time.
Additional waiting, loading or unloading time beyond the agreed allowance may incur an additional charge.
Where a significant delay makes completion of the job impractical, Phil’s On It may rearrange or terminate the job and charge reasonably for time, mileage and costs already incurred.
7. Customer responsibilities
The customer must provide accurate information about:
- the items being transported;
- their approximate size, weight and quantity;
- collection and delivery addresses;
- stairs, restricted access, parking restrictions or other access issues;
- particularly fragile, valuable, unusual or difficult items; and
- anything else that could reasonably affect the safe or practical completion of the job.
The customer must have authority to arrange the collection and transportation of the items.
A significant difference between the information provided and the actual job may result in the price being revised or the job being declined.
8. Packaging and preparation
Items must be suitably packed, secured and prepared for normal road transport.
Fragile or vulnerable items must be appropriately protected.
Phil’s On It may refuse an item that, in Phil’s reasonable judgement, is inadequately packed, unsafe, excessively heavy, unsuitable for the available vehicle, likely to cause damage or otherwise inappropriate to transport.
This decision may be made before booking or at the collection point where the actual item or circumstances differ from those described.
Where a job cannot proceed because information supplied by the customer was materially inaccurate, or items were not reasonably prepared for transport, the customer cancellation terms may apply.
9. Items not accepted
Phil’s On It will not knowingly transport:
- illegal or stolen goods;
- dangerous, explosive, highly flammable or hazardous materials;
- prohibited or controlled substances;
- weapons or other items whose transportation would be unlawful;
- unsecured animals;
- items that cannot safely or legally be transported in the available vehicle; or
- any item Phil reasonably considers inappropriate or unsafe to transport.
Phil’s On It reserves the right to decline unusual items before booking or at the collection point where their condition, packaging, dimensions, weight, legality or other circumstances make transportation inappropriate or unsafe.
Customers should disclose unusual items before confirming a booking.
10. Valuable and fragile items
The customer must identify particularly valuable, fragile, irreplaceable or unusual items before booking.
Phil’s On It may decline such items or require additional arrangements before agreeing to transport them.
Customers should not assume that an item is suitable for transport or covered by insurance simply because a booking has been requested or accepted.
11. Goods in Transit insurance
Phil’s On It maintains Goods in Transit insurance, subject to the terms, conditions, exclusions and limits of the applicable insurance policy.
Insurance does not remove the customer’s responsibility to package and prepare goods appropriately.
Particularly valuable or unusual goods must be disclosed before booking so their suitability for transport can be confirmed.
12. Loss or damage to goods
Phil’s On It will exercise reasonable care and skill when handling and transporting customers’ goods.
Any visible loss or damage should be reported as soon as reasonably possible after delivery, together with photographs or other relevant information where available.
Phil’s On It will not be responsible for loss or damage that was not caused by a failure by Phil’s On It to exercise reasonable care and skill, including loss or damage resulting from:
- inadequate or unsuitable packaging;
- inherent defects or weaknesses in an item;
- pre-existing damage;
- inaccurate or incomplete information supplied by the customer; or
- circumstances outside reasonable control.
Nothing in these Terms & Conditions excludes or restricts liability where doing so would be unlawful.
13. Access, parking and additional charges
The customer is responsible for providing reasonable access at collection and delivery locations and for advising Phil’s On It beforehand of known restrictions.
This includes restricted roads, height or width restrictions, stairs, difficult loading areas, permits and unusual parking arrangements.
Parking, toll, congestion, clean-air or similar charges arising specifically from the journey may be added to the agreed price where they were not already included in the quote.
14. Driver Only service
Under the Driver Only service, the customer provides the vehicle and Phil provides the driver.
The vehicle may be customer-owned, borrowed, leased or hired.
Before the job, the customer must provide or make available satisfactory evidence that the vehicle:
- has a valid MOT, where required;
- is correctly taxed;
- has valid insurance specifically permitting Phil to drive the vehicle for the intended journey and use;
- is roadworthy, properly maintained and legally compliant;
- is suitable for the proposed journey and load; and
- will not exceed applicable weight, loading or other legal limits.
Phil’s On It may request evidence of the vehicle’s MOT, tax, insurance and, where applicable, hire or lease agreement and permission for Phil to drive the vehicle before accepting or commencing the job.
The customer is responsible for ensuring that information and documentation supplied is accurate, valid and applicable to the intended use.
Driver Only – Booking Time and Additional Costs
Driver Only bookings are charged on a door-to-door basis. Booking time starts when Phil leaves his Staffordshire base and ends when he returns, except where a separate return journey or overnight arrangement has been agreed.
Booking time includes any required or appropriate driving breaks.
Half-day bookings provide up to 4 hours and full-day bookings provide up to 8 hours. Additional time is charged at the rate agreed at booking.
The customer is responsible for fuel, tolls, parking and other vehicle-related journey costs unless otherwise agreed.
Published Driver Only prices do not include overnight accommodation or the cost of Phil’s return travel following a one-way journey. Where these are required, the additional costs will be agreed with the customer before the booking is confirmed.
Vehicle condition, breakdown and maintenance
The customer is responsible for the roadworthiness, mechanical condition, servicing, maintenance and pre-existing condition of the vehicle.
Phil’s On It is not responsible for mechanical failure, breakdown, tyre failure, component failure, wear and tear, pre-existing damage or defects unless directly caused by Phil’s failure to exercise reasonable care and skill.
Phil’s On It will not be responsible for repair, maintenance, recovery or replacement costs arising solely from the vehicle’s condition, defect, normal wear and tear or mechanical failure.
The customer should identify and record existing vehicle damage before Phil takes control of the vehicle.
Phil’s On It may photograph or otherwise record the condition of the vehicle before and after the job.
Hired, leased or borrowed vehicles
Where the vehicle is hired, leased, borrowed or otherwise supplied by a third party, the customer remains responsible for their agreement with that third party.
The customer must ensure that the agreement permits Phil to drive the vehicle and that appropriate insurance is in place for the intended use.
The customer remains responsible for hire charges, deposits, insurance excesses, damage waivers, administration charges, recovery charges, loss-of-use charges and other charges imposed by the vehicle owner, hire company, leasing company or insurer, except to the extent that a loss or charge is directly caused by Phil’s failure to exercise reasonable care and skill and Phil’s On It is legally responsible for that loss.
Phil’s On It does not accept responsibility merely because a vehicle owner, hire company, leasing company or insurer imposes a charge on the customer. Any claim against Phil’s On It must relate to loss or damage for which Phil’s On It is legally responsible.
Accidents and external damage
Phil will exercise reasonable care and skill while driving and looking after the vehicle.
Phil’s On It will not be responsible for loss or damage that was not caused by a failure by Phil to exercise reasonable care and skill, including loss or damage caused solely by other road users, vandalism, theft, weather, road conditions or other external events.
Where an accident, damage or other incident occurs, Phil will provide reasonable information and assistance to allow the customer and relevant insurer to deal with the matter.
Refusing a vehicle
Phil may refuse to drive, or may stop using, any vehicle where he reasonably considers the vehicle, documentation, insurance, load or proposed use to be unsafe, unsuitable or unlawful.
Where a Driver Only job cannot proceed because the customer has failed to provide a suitable, roadworthy, legal and appropriately insured vehicle or the required documentation, this may be treated as a customer cancellation, and the normal cancellation terms may apply.
15. Delays outside reasonable control
Phil’s On It will make reasonable efforts to complete each job as agreed but cannot guarantee freedom from delays caused by events outside reasonable control.
Where disruption occurs, Phil will communicate with the customer and make reasonable efforts to complete or rearrange the service.
16. Liability
Phil’s On It does not exclude responsibility for losses caused by its failure to provide the service with reasonable care and skill, or any other liability that cannot lawfully be excluded.
Phil’s On It will not be responsible for losses that were not caused by a breach by Phil’s On It or that could not reasonably have been foreseen when the booking was made.
Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability which cannot legally be excluded.
17. Complaints
If something goes wrong, customers should contact Phil’s On It as soon as reasonably possible so there is an opportunity to investigate and resolve the matter.

18. Changes to these Terms & Conditions
These Terms & Conditions may be updated from time to time.
The terms applying to a booking will normally be those supplied or made available when that booking was confirmed.
19. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
